I CONFIRM THAT I HAVE READ THE BELOW TERMS AND CONDITIONS AND AGREE TO THE FOLLOWING:
All statements contained in this application for a loan/lease/mortgage from the Company are true and complete, and were made for the purpose of obtaining such loan/lease/mortgage, and such application includes the express representation that I am not being sued, that there is no unsatisfied judgement against me and that I am not indebted to any other lending institution except as shown within application.
I undertake to notify the Company immediately on any situation which materially changes the representation of this application.
The Company shall have power to charge any deposit account which I presently maintain or shall maintain in the event that the loan/lease/mortgage becomes delinquent and is not being paid and I agree to pay the usual Company charges and all costs, charges and expenses which the Company may pay or incur in stamping, perfecting, or enforcing this agreement or in obtaining payment or discharge of my loan/lease/mortgage according to the terms of my promissory note/mortgage bill of sale/ lease agreement/mortgage deed.
That I have not been bankrupt, insolvent, or made any arrangement with my creditors.
That I have not been refused a loan on this security, nor am I being pressed for payment by the present mortgagees if any.
That Valuation Fees/Committal Fees/Investment Fees/Charges, all legal expenses & charges, taxes, duties, etc. shall be borne by me, in addition to any expenses necessary to perfect title; and I further agree that should the title be found unsatisfactory, or should I decline or omit to take up the amount granted I will forthwith pay all expenses incurred in consequence of this application.
That any mis-statement of facts herein shall entitle the Company to cancel the loan/lease/mortgage or to require immediate payment of all monies including monies secured by the mortgage.
The Borrower authorise and consent for Fidelity to obtain, give to, share and exchange credit and other information about myself with others, including credit bureaus, credit insurers, registries, other persons with whom you have financial dealings, as well as any other person, as may be permitted or required by law. I jointly and severally agree to indemnify you against any loss claims, damages, liabilities actions and proceedings, legal and or other expenses which may be directly or reasonably incurred as a consequence of such disclosure on your part.
That I will insure the buildings/assets/equipment with a company approved by Fidelity Finance & Leasing Company Limited to the full insurable amount satisfactory to the Company. In the case of a Maritime Life mortgage such insurance shall be effected with Maritime General Insurance Company Limited. I undertake to provide the Company with evidence of renewal of such insurance during continuance of the mortgage.
I agree, should your Company loan me the above amount, or any part thereof, to keep the property in good state of repair.
I AGREE TO PAY ALL RATES AND TAXES AND CHARGES AS THEY BECOME DUE, AND TO EXHIBIT RECEIPTS OR SUCH CERTIFICATES OF SUCH PAYMENTS EACH YEAR TO THE COMPANY; AND TO SUBMIT THESE RECEIPTS/CERTIFICATES AT SUCH OTHER TIMES AS AND WHEN REQUESTED/REQUIRED BY THE COMPANY
